Supercar Breakfast Club Terms of Business

Aims
The Supercar Club for touring, great company and the finer things in life.

Definitions:
"The Club" means the Supercar Breakfast Club
"Membership" means the membership given to Members upon payment of membership fees.
"The Members" means the members of The Club.
"Club events" means the exclusive events run by The Club.

The Club agrees to:
1.1     Offer Members access to an online platform / website that details forthcoming events.
1.2     Provide Members with an Option to register for Club events.
1.3    Provide information regarding forthcoming events including joining criteria.
1.4    Provide an approved car list that is regularly reviewed.
1.5    Provide Members with email contact regarding forthcoming events.
1.6     Provide navigation and / or a suggested route for each drive although Members are responsible for navigating to the associated locations.

The Club reserves the right to:
2.1    Cancel events due to poor weather conditions or poor take up from Members.
2.2    Seek to resolve disputes swiftly and effectively using their own internal dispute resolution procedures.
2.3    Issue Members with a written warning on a first breach of terms and conditions or grievance.
2.4    Cancel Membership after a second written warning.
2.5    Cancel Membership forthwith in the event of a serious breach of any terms and conditions, misconduct or if any of the Directors believe that continued Membership is detrimental to the best interest of the Club and other Members.
2.6    Cancel Membership if Members are deemed by the Club to have driven in a dangerous, anti-social / inconsiderate or reckless manner or have broken any road traffic laws.
2.7     Cancel Membership if the Directors consider behaviour of any Member or person under their control to be offensive, discriminatory or not in keeping with the aims and values of the Club.
2.8    Amend these terms and conditions without prior notice.

Members understand and agree to:
3.1    Accept the terms and conditions of Membership.
3.2    Accurately complete the online application.
3.3    Agree to a minimum of twelve months Membership that begins from the date payment is received.
3.4    Members understand and agree that no refund for membership is given if the membership is cancelled before the end of the year term.
3.5    Membership and this Agreement are personal to you and may not be assigned to anyone else.
3.6    That complimentary Membership may be offered by one of the Club partners.
3.7    Use the website to pay for Membership. Payments are by bank transfer only and are due annually on the Annual Renewal Date. 
3.8    Give a minimum of 14 days’ notice prior to the Annual Renewal Date if they wish to terminate membership.
3.9    Keep the Club updated with personal details such as current email, mobile phone number or postal address.
3.10    Pay where applicable fees for Club events in accordance with each events specific terms and conditions.
3.11    Keep details of the Club Events private and not share on social media or any public forums or websites.
3.12    Ensure that local driving laws and speed limits are observed at all times.
3.13    Be respectful to all Members; drive courteously when with other Members and the general public.
3.14    Ensure they are physically and mentally prepared for each Tour, Drive or Event and that their car is in good working order.
3.15    The Club is not a racing club and there is no reward for those who arrive at destinations or meeting points first.
3.16    Pay any fines, penalty charges or costs connected with Members vehicles whilst on Club Events.
3.17    Not pose as an employee or agent of the Club without express written permission to do so.
3.18    Give the Club permission to use photos of the Member and their car for promotional purposes unless otherwise stated. The Club retains the right to allow duplication and publication of any associated images unless Members expressly request otherwise.
3.19    Not promote rival events or clubs during Club events.
3.20    Not to post unauthorised advertising or soliciting on the Club website or social media platforms. Any such posts will be removed.
3.21    Comply with the rules and regulations of the Club specific to each Club event as asset out in the attached Schedules.

Exclusion of Liability
4.1    Attendance at events is at Members own risk and the Club accepts no responsibility for any damage to cars or persons during an event.
4.2    The Club cannot be held responsible for the driving of Members or other road users. The Club accepts no responsibility for these risks. 
4.2    Code of Conduct: All participants must conduct themselves responsibly and in an appropriate manner at all times. We take no responsibility for your conduct on our tours.

Club Events, Drives and Tours organised by the Club:
5.1    Drives and Tours organised by the Club are bookable via the website with the following conditions
5.1.1    Deposits to be paid in full as identified for each event.
5.1.2    Payment in full is required at least 6 weeks prior to any Tour.
5.1.3     Payment for day drives is non-refundable.
5.2    Handsfree walkie talkies are used during Club events to inform Members of route progress. Members that use the sets do so entirely at their own risk.
5.2.1    Although the Club recommend the use of handsfree walkie talkies to communicate with other Members, it is the responsibility of passenger(s) to use them.
5.2.2    Under no circumstances should handsfree walkie talkies be used to encourage overtaking or other dangerous manoeuvres.
5.2.3    Information from handsfree walkie talkie messages can be unreliable. The Club accepts no liability for accidents associated with the use of handsfree walkie talkies.

Booking and Payments
6.1    All registrations are made via the Club website.
6.2    All events are offered subject to availability and on a first come first served basis.
6.3    There shall be no formal and binding contract between Members and the Club until the requested deposit (or where appropriate the full amount due) has been received.
6.3.1    Day drives deposits are due in full when the booking is made.
6.3.2    Tour deposits are due as described for each event.
6.4    Failure to pay the balance of any deposit (or where appropriate the full amount due) as requested will lead to a cancellation of the booking.
6.5    The Club reserves the right to cancel or refuse any bookings at their sole discretion.

Cancellations of an Event or Tour
7.1    Cancellations must be in writing.
7.2    Cancellations made twelve weeks or more prior to the Club event will be given a refund less an administration fee of no less than £100.
7.3    Cancellations within twelve weeks of the Club event will be given a refund less an administration fee of no less than £100 on condition that the place on the Club event from which the Member withdrew can be resold. If it cannot be resold full payment will be retained by the Club.
7.4    Cancellations within six weeks of the Club event will be given a refund less an administration fee of no less than £300 on condition that the place on the Club event from which the Member withdrew can be resold. If it cannot be resold full payment will be retained by the Club.
7.5    Cancellations within one week (7 days) of the Club event will not be refunded and full payment will be retained by the Club.

Force Majeure
8.     The Club cannot accept liability or refund monies if a Club event has to be altered or cancelled due to any circumstances outside their control or that that could not be foreseen or avoided, such as (but not limited to) war, threat of war, riot or civil unrest, disease, terrorist activity, industrial disputes, natural disasters, adverse weather conditions, ferry delays or traffic delays. Neither will the Club be held responsible if attractions change their opening times or are closed or the Club Event is amended in any way from the original scheduled event as a result.

Governing Law
9.     These terms and conditions and Member’s participation in Club events are governed by English law and the jurisdiction of the Courts of England.


Schedule 1 Supercar Breakfast Club Meet - Terms and Conditions
General Admission Tickets
1.Your ticket is and remains at all times the property of the Club.
The ticketholder shall not:
(a) use, offer or apply the ticket as a prize or in any other manner in a lottery or competition or for any other promotional, advertising or commercial purpose; or
(b) sell, resell, donate, transfer or in any way dispose of the ticket to any person/entity via any media (including without limitation on the internet) for the purpose of commercial gain or otherwise.
2. The ticket shall be void if purchased or obtained in contravention of condition 1 above or from any person/entity who is not an authorised agent of the Club, and the ticketholder may be refused entry to or ejected from the events as a result, without prejudice.
3. The ticket is required to gain admission to the event. Receipts are not acceptable. Any attempt to present any unofficial or counterfeit ticket may lead to refusal of admission and possible prosecution. Unauthorised vendors will be prosecuted.
4. Please keep tickets safe and in good condition.
5. Tickets relate to access to public areas of the venue only. The ticketholder shall not access or attempt to access any other areas including without limitation the track or other areas. Offenders will be prosecuted.
6. The Club may refuse admission and/or remove persons from the venue if, it is judged that they represent a security or safety risk or a nuisance or other detriment to the event. The Club may choose to conduct security searches to ensure the safety of persons at any event. Proof of identity may be required in order to gain access to the venue. Pass-outs and readmission to the venue shall be granted at the Club’s discretion.
7. No animals are admitted to the venues, car parks or campsite, except guide dogs.
8. The date of the event may be subject to change, in which circumstances ticketholders agree that their tickets will be valid for the event as changed, and no refunds or exchanges will be available.
9. The ticketholder shall be entitled to a refund or exchange in respect of their ticket if the event is cancelled in its entirety prior to the commencement of the event for reason(s) that are within the reasonable control of the Club.
10. If an event is cancelled or otherwise changed for reasons that are beyond the Club’s reasonable control including, but without limitation, compliance with any law or governmental order, rule or restrictions, adverse weather, fire, disease, war or terrorist activity, commotion, acts of God, strikes or other industrial action, breakdown of plant, machinery or any failure of gas, water service, electricity or similar supplies, then the Club shall in such circumstances have no liability to the ticket holder for any loss or damage suffered as a result of such cancellation or other change.
11. The Club, the organiser and authorised third parties may record or make audio, visual or audio-visual recordings of the event and the ticketholder hereby consents to the use of his or her likeness, image and/or voice within such recordings free of charge.
12. For security purposes, CCTV cameras are in use in and around the venue and the tickerholder agrees that organisers may pass onto any relevant authority any recordings for use in any proceedings.
13. These terms and conditions are governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
14. Drones/UAVs are not permitted for use on any event day without the express permission of the Club.
15. Ticketholders acknowledge that they may be exposed to the risk of physical harm due to the nature of the event. The Club will not be liable for any injury, loss or damage to you or your property except to the extent that any such injury, loss or damage is caused by the negligence of the Club, its employees or authorised agents. Without prejudice to the foregoing, the Club excludes to the maximum extent permitted by law any liability for such injury, loss or damage.

Schedule Two Track Sessions – Terms and Conditions
1. By booking a track session with the Club you agree to ensure that your vehicle is fit for purpose, mechanically sound and safe. You agree to abide by any rules that may be applicable to the event and you agree that your vehicle will comply with any noise requirements of the event. Failure to follow any of these rules may see you removed from the event and no refund or credit will be issued. Similarly if your vehicle suffers mechanical issues which prevent or limit participation, no refund or transfer will be given.
2. Motoring events can be dangerous involving the risk of death or serious injury to participants. It is a condition of admittance that Members and their passengers will be required to sign a Drivers or Passengers Indemnity Form prior to entering the pit-lane. This means that Members accept full responsibility for any personal injury or damage to their own vehicle, howsoever caused. This indemnity will not apply to such liabilities etc, which have been established to have been due to the negligence of the Club or its employees or agents.
3. It should be noted that many Road Car Insurance policies do not cover the vehicle for damage whilst in trackday use. Trackday insurance is optional and may be available via the Club, on request.

Schedule 3 Supercar Breakfast Club Tours - Terms & Conditions

Registration Process

A Deposit payment is taken through the website at booking. Once payment is received you acknowledge you are committed to the tour in full. Any cancellations with be dealt with as per our cancellations policy. Remaining balance is invoiced 12 weeks prior to the tour.
Payment is required no later than 12 weeks prior to the tour, or the Club may reserve the right to cancel your space without refund.
Some tours require a minimum number of bookings to make them viable. Should this tour not meet the minimum numbers, you will be reimbursed for any payments relating to this tour made to the Club. It is not advised to book flights and other travel arrangements until Tours are fully confirmed. If the tour is cancelled due to lack of numbers Members will be notified in good time.

Methods of Payment

The non-refundable admin fee and deposit is paid by credit/debit card via the website. The remaining balance can be paid by the same means.

Cancellations by the Customer

Cancellations should be made in writing via email
•    If cancelling more than 12 weeks prior to the start of the tour, the Club will attempt to sell on your space and will refund you the price at which your package has been sold on, less a £100 admin fee.
•    If Members cancel within 6 weeks before the start of a tour, the Club will attempt to sell the space and if successful, will refund the sale price on the space, less a £300 admin fee.
•    If Members cancel within one week (7 days) before the start of a tour, the Club will not offer a refund and will retain all monies paid for that event.
•    Although we make every attempt to sell on cancelled spaces to other Members, this is not guaranteed. It may result in the loss of payments at whatever stage the Member decides to cancel. In the instance that a cancelled space does not sell, the Club will only be able to refund any monies recovered from hotels and other establishments relating to the tour, less the above admin fees. In some cases, this may result in the loss of all payments received before the date of cancellation.
•    When selling on a cancelled space at short notice, the Club may advise that it is sold on at a reduced rate to encourage another Member to snap up a last-minute deal. The difference in the original sale price and the resale price will be deducted from the refund if applicable, on top of the relevant admin fee.
•    Extra nights which have been booked will also be offered but in some instances please be aware these may be lost if the person booking your space does not want to include them in their booking.
•    Refunds will only be issued after the Member taking a cancelled space has paid in full to the amount that has been invoiced at the necessary stage. 
•    Late payment of the final deposit may result in the space being cancelled and no refund being issued.
Non-payment will result in loss of full deposit and space on the tour.

Cancellations by the Club

The event organisers cannot accept liability or refund monies if the Driving Tour has to be amended or cancelled due to any unforeseeable circumstances outside the Clubs control. If the Club chooses to cancel a tour when the decision is not forced, then the following will be applicable:
•    Admin fee will be refunded in full if the initial deposit has been paid.
•    Admin fee will not be refunded if the initial deposit has not been paid.
•    The initial deposit will be refunded in full.

Waiting List

If a tour is fully subscribed the Club recommends Members register interest on a waiting list and the Club will notify Members should a place come available. By registering on the waiting list Members have no obligation to attend the tour if a space comes available.
The admin fee will not be charged during registration but included within the deposit.

Changes/Cancellations 

The Club reserves the right to change the event itinerary, route and hotels at any time without notice. Where changes occur to a driving tour we will notify Members as soon as practicable and provide alternate options. Should an element of the tour change the Club will endeavour to replace that element as a like for like. An additional cost or refund may apply. Any participants who have not paid their final balance including any late fees within 30 days of any event will be cancelled without refund.

Requests for Changes to a Driving Tour

An administration fee might be applicable should you wish to make any amendments to your booking, such as room types.
Required Documents for the Driving Tour
a) Driving Licence (international driving licence) – all drivers must hold a valid full UK driving licence.
b) Vehicle insurance + Green card from insurance company. – for all drivers.
c) V5C (log book) or ‘vehicle on hire’ certificate.
d) MOT certificate – as the condition of a vehicle may deteriorate within the period of an MOT, it is your responsibility to ensure that your vehicle is in a roadworthy condition for the event.
e) Valid Passport – for all participants.
f) Travel insurance - it is the Members responsibility to ensure they have appropriate travel insurance in place for passengers, personal effects, luggage and the vehicle. It is the sole responsibility of the participants to ensure that their documents are in order. They must be valid from the beginning up to and including, the last day of the tour.

Legal Compliance & Local Laws

All participants must drive safely and at all times obey the specific regulations for each country visited. This includes (but is not limited to) speed regulations, highway laws, vehicle safety laws and laws relating to the possession or use of alcohol or drugs. It is up to Members to ensure that they are fully up to date with the driving requirements for each country visited. Some countries require Members to carry certain safety equipment.

Personal Expenses

The tour price does not include any personal expenses incurred during the tour, such as fuel, tolls, food, drink, fines, repair costs or any other expenses of any kind.

Responsibility

The Breakfast Club accepts no responsibility for the consequences of Members being refused entrance or exit in to or out of any country or city during tour including any costs incurred, this is all the participant’s responsibility and in particular, any additional costs incurred are solely the participant's responsibility.

Indemnify

Members will indemnify the organiser, its directors, officers, employees and agents against any and all claims, lawsuits and causes of action whatsoever or howsoever arising and brought against them by any third party as a result of a Members action or participation in an event, including without limitation, the Members violation of any laws or regulations or breach of these Terms and Conditions of entry.

Code of Conduct

All participants must conduct themselves responsibly and in an appropriate manner at all times. Members must not consume alcohol whilst driving, driving whilst under the influence of alcohol (or any other intoxicating substance) or drive if ability to do so safely is compromised by illness, lack of adequate rest, or any other condition. Any illegal behaviour will result in the cancellation of participation without refund. Furthermore, any careless or reckless driving will result in expulsion from the remainder of the tour without refund. Club Membership will also be terminated without refund. Directors of The Club reserve the right to terminate Club Membership due to inappropriate actions of Club Members deemed unacceptable, offensive or outside the spirit of the the Club.

Image Rights

All participants consent to be photographed and to be included in any filming of a driving tour. Members consent to the use of image, likeness, voice and biographical material in connection with any and all footage, publicity and related promotional material. Participants are only entitled to take photographs and film footage of the event for personal non-commercial purposes.

Copying the Event

By agreeing to the Terms Members are agreeing that they will not organise, invest or fund a rally or similar driving event which attempts to replicate this tour or any of its unique features, activities and components or which seeks to benefit in any way from the Club’s branding or goodwill.

Transfers

Once a registration fee or deposit payment has been paid for entry into a tour, this fee is non-transferable to any other future tour or event, any other Club Members or any part payment of any future tours or events unless a pre-arrangement is agreed with the Club prior to making a booking.

Force Majeure

The Club cannot accept liability or refund monies if the event has to be amended or cancelled due to any circumstances outside our control or that could not be foreseeable or avoidable. Such as (but not limited to) war, the threat of war, riot or civil unrest, disease, terrorist activity, industrial disputes, natural disasters, adverse weather conditions, ferry delays or traffic delays. Neither can the Club be held responsible if certain attractions change their opening times or are closed.

Travel Delays

It is the nature of making bookings in advance that prearranged events may be delayed for reasons out of the Club’s control. Any travel delays both before and during a tour, whether foreseen or not, can in no way be deemed to be the Club’s responsibility and therefore we will not be liable for any extra costs you may incur. Examples of such costs are, but not limited to, hotels, ferry crossings, hire cars, meals and drinks. These conditions apply regardless of how the delays were brought about. Examples are, but not limited to, adverse weather conditions, natural disasters, technical difficulties industrial disputes. For whatever reason Members are unable to complete a tour they will in no circumstances be entitled to any refund for any unused services booked.

Disclaimer of Warranty

Members agree to indemnify the Club, its officers, directors, employees, agents and partners against any and all claims, lawsuits and causes of action brought against them by any third party as a result of participation in an event, including without limitation, violation of any laws or regulations or breach of these Terms and Conditions of entry.

Violation of Terms

If any participants violate any of the above terms and conditions or refuse to follow the instructions given prior or during the tour by the Club, Members may be prohibited from any or further participation in the event.
